Terms & Conditions

Before purchasing a tour package, i.e., before availing yourself of MaroWays d.o.o.’s services, please take the time to carefully read, your chosen tour package program and the rules of implementation of the same, as detailed on the website.

  1. Terms & Conditions

These terms and conditions, together with the program of the chosen trip or excursion (hereinafter referred to as tour package), form an integral part of the travel contract between MaroWays d.o.o., with registered office in Kraška ulica, 2 SI – 6210 Sežana (hereinafter referred to also as organizer) and the traveller.

The combination of the travel services, for which a tour package contract is concluded, is considered a tour package pursuant to the law on consumer protection. Thus, all EU rights that concern tour packages shall apply.

If the tour package provisions are different from those in the terms and conditions, the provisions included in the tour package shall prevail. If the tour package program received by the traveller/s by email is different from the one published online, the provisions included in the program received by the traveller/s by email shall prevail. 

  1. Booking

The traveller may book a tour package in person at the offices of MaroWays d.o.o., on the website, or by email. Based on their request, MaroWays d.o.o. will send to the traveller the tour package program, the terms and conditions, the registration form and information on the payment method. The travel contract, together with these terms and conditions and the tour package program, will be considered concluded once the organizer receives the registration form duly completed (in person, by post or by email) and payment for the deposit. After receiving the registration form and the deposit payment, MaroWays d.o.o will forward the booking confirmation to the traveller.  

After receiving the registration form and the deposit payment, MaroWays d.o.o. guarantees to the traveller their participation in the chosen tour package, in accordance with the provisions of these terms and conditions.

At the booking stage, the traveller is required to provide the organizer with correct and truthful information, in accordance with their ID. In the event that the traveller provides false or incorrect information, they shall be responsible for all the expenses and consequences derived from it. 

The traveller is allowed to register third parties for the same trip after having received the confirmation of their interest. In this case, the traveller assures the organizer that they have informed the other participants of these terms and conditions.

If the traveller sends the registration form and makes a deposit payment when all places in the selected tour package have already been filled, the contract shall be deemed invalid. In this case, MaroWays d.o.o shall inform the traveller immediately and will refund them any payment made. 

  1. Price and payment

The prices of the tour packages are set out in the program and apply from the date of their publication. The price of the tour package includes all services indicated in the program itself. If not otherwise specified in the program, the prices are per person with accommodation in a double room.  The prices are defined in Euro and include VAT and any additional charges (such as for example, tourist tax or city tax). The traveller is bound to the price in force at the date he signs the travel contract, except in the event of subsequent modifications as regulated in the following points of these terms and conditions.    

The day when MaroWays d.o.o.  receives the deposit payment on its own bank account will be considered as the date of payment. Upon booking, the traveller is required to pay a deposit, equal to 30 % of the total, unless otherwise specified in the program of the tour package. The remaining amount is required 30 days before departure unless otherwise specified in the program of the tour package. If the traveller fails to pay the above-mentioned sum at the agreed dates, they will be considered to have withdrawn from the contract. In this case, the organizer shall follow the provisions of point 4. of these terms and conditions.   

For bookings made after the date indicated as the deadline for paying the balance, the full amount must be paid when the purchase offer is accepted.

The traveller may pay the deposit and the balance of the price of the tour package using the following methods: 

  • through a bank transfer to the bank account owned by MaroWays d.o.o.;
  • by credit/debit card or account PayPal, using the PayPal payment platform (please note that additional cost apply when paying by PayPal payment platform. The costs are currently 4% of the whole amount for payments from countries belonging to the European Economic Area; 6% for the rest of the world);
  • at the office in cash.

All the information necessary to make the payment will be communicated to the traveller together with the tour package program, the terms and conditions, and the registration form.

MaroWays d.o.o. reserves the right to change the price, pursuant to the provisions below, as a result of changes in the exchange rate applied to the tour package in question, changes in transportation costs, based on the cost of fuel or other energy sources, and changes to the fees and charges applicable to some types of tourist services included in the package and charged by third parties not directly involved in the execution of the package (such as for example, taxes, landing fees, mooring fees and boarding fees in ports and airports), that affect the price of the package. MaroWays d.o.o. will communicate in writing any variations in price to the travellers, at the latest 20 days before the date of departure.

In the event of changes to the transportation costs or to the fees and charges due to third parties, the price of the tour package will increase by the same amount that the transportation cost, the fees and charges have increased between the date when the travel contract was signed and the variation in the price of the tour package was communicated to the traveller in writing.

If the price variation exceeds 8% of the original price amount, the traveller has the right to withdraw from the travel contract, pursuant to paragraph 3 of point 6. of these terms and conditions.

In the event that variations in the exchange rates applied to the tour package in question, variations in the transportation costs, based on the cost of fuel or other sources of energy, or variations in the fees and charges applicable to some types of tourist services included in the package and imposed by third parties not directly involved in the execution of the package, determine a decrease in the price of the tour package between the date the travel contract was signed and the date of departure, the traveller has the right to be refunded the excess already paid. The organizer has the right to withhold any administrative exposes incurred as a result of the diminution in price.   

  1. Right of withdraw of the traveller and traveller replacement

The traveller has the right, at any moment, to withdraw in writing from the travel contract. If the traveller withdraws from the contract, the organizer shall refund him within 14 days, reserving the right to withhold the withdrawal expenses/fines indicated below: 

  • For withdrawals made between 59 and 30 days before the beginning of the trip: 10% of the total amount to cover the management costs
  • For withdrawals made between 29 and 15 days before the beginning of the trip: 50% of the total amount
  • For withdrawals made between 14 and 7 days before the beginning of the trip: 75% of the total amount
  • For withdrawals made between 6 and 1 days before the trip: 100% of the total amount

If the traveller does not withdraw from the travel contract in writing before the beginning of the trip and does not participate in the trip, he is not entitled to a refund.

In the event that the traveller cannot take part in the trip, they can be replaced by another person, if the latter meets all the conditions of the chosen tour package. The transferor traveller must inform the organizer of this in writing at least 7 days before the beginning of the trip. In this case, the transferor must refund the organizer all the expenses incurred for the substitution. In the event that third parties necessary for the execution of the tour package (e.g., airlines) do not allow a booking replacement, the transferor will not be able to take advantage of the rights described in this paragraph.

The traveller may withdraw in writing from the travel contract during the trip itself as well. In this case, the traveller is not entitled to a refund (not even a partial one) of the sums paid to the organizer, nor of any other expenses incurred. The following are  considered a withdrawal from the travel contract: (i) during the trip, the traveller independently, without a valid cause and without the consent of the organizer, interrupts the chosen tour package; (ii) the traveller is not accepted aboard the means of transportation (air, sea, land or others) for security reasons or regulations imputable to the traveller himself; (iii) the traveller independently and with the consent of MaroWays d.o.o., partially modifies the tour package.

The traveller may withdraw from the travel contract because of extraordinary and inevitable circumstances that modify significantly the performance of the tour package and must, in this case, present relevant evidence. In this event, the traveller is entitled to a full refund, from which only the expenses that the organizer incurred for the registration and the eventual participation in the tour package can be withheld. Whenever withdrawal from the travel contract for extraordinary and inevitable circumstances arises during the performance of the tour package, the organizer offers to the traveller the necessary support.

In case of withdrawal on the part of the traveller, they do not have the right to a refund of the expenses connected to the tour package, such as expenses for obtaining visas, obligatory or recommended vaccines, purchase of flight, bus, boat or train tickets.

  1. Organizer’s right to cancel

MaroWays d.o.o. reserves the right to cancel the travel contract if, because of inevitable and extraordinary circumstances, it cannot perform the tour package pursuant to the provisions of the program of the package itself or the provisions contained in these terms and conditions, or if the number of travellers registered to the tour package is lower than the minimum foreseen in the travel contract. In this case, the organizer will cancel the contract and refund in full the payments made by the traveller for the tour package. The reimbursement does not include any expenses incurred by the traveller due to the cancellation of the tour package. The right to cancel on the part of the organizer may be invoked:

  • 20 days before the beginning of the tour package for packages that last longer than 6 days;
  • 7 days before the beginning of the tour package for packages that last between 2 to 6 days;
  • 48 hours before the beginning of the tour package for packages that last less than 2 days.

In the event of cancellation on the part of the organizer, the traveller is not entitled to be refunded the expenses connected to the tour package that are not included in the price itself (such as for example, expenses to obtain visas, obligatory or recommended vaccines, any insurance policies, or flight, bus, boat and train tickets).

MaroWays d.o.o. reserves the right to cancel the travel contract, before the beginning of the tour package or during its performance, and will be entitled to request a refund for expenses/damages from the traveller, if they directly violates the provisions of the travel contract that they have signed.  In particular, if the traveller has voluntarily communicated incorrect information regarding the number and the age of the participants, or if during its performance, he has modified the tour package without informing MaroWays d.o.o.

  1. Organizer’s right to modify the tour package

MaroWays d.o.o. reserves the right to modify the program and these terms and conditions. Any modification will be promptly communicated to the traveller by email.

MaroWays d.o.o. reserves the right to modify the program of the tour package and/or its beginning date in the event of inevitable and extraordinary circumstances that the organizer could not foresee or avoid, that arose before the beginning or during the performance of the tour package (e.g., natural catastrophes, particularly unfavourable weather conditions, situation of political insecurity, changes in the transportation schedule and other schedules, etc.). In this case, MaroWays d.o.o. is not responsible for the expenses/damages incurred by the traveller because of the changes in the tour package.

In the event of significant changes either in the tour program or in these terms and conditions, the traveller has the right to withdraw from the travel contract according to the terms set out in the initial agreement regarding changes to the above. If the traveller does not respond in time, the travel contract will be considered cancelled by the traveller. In this case the traveller and the organizer may agree to the execution of an alternative tour package of the same quality. If an agreement is not reached, within 14 days from the withdrawal, the organizer will issue a refund of the amount paid by the traveller, including fines.

If the tour package is modified by the organizer, the traveller is not entitled to be refunded the expenses connected to the tour package that are not included in the price itself (such as for example, expenses to obtain visas, obligatory or recommended vaccines, any insurance policies, or flight, bus, boat and train tickets).

MaroWays d.o.o. is not responsible for any booking errors attributable to the malfunctioning of the booking systems or linked to the travellers’ behaviour. 

  1. Weather conditions

The majority of the tour packages offered by MaroWays d.o.o. take place outdoors, so the execution of the program may be influenced by meteorological conditions, such as for example strong winds or unexpected rain. MaroWays d.o.o.  endeavours to do its best to monitor accurately the weather predictions. If it is assumed that before the start of the tour package or during it, due to adverse weather conditions, the program of the tour package cannot be carried out or the weather conditions may affect the safety of the traveller, MaroWays d.o.o. reserves the right to change or cancel the travel contract pursuant to the provisions in points 5. and 6. of these terms and conditions.

  1. Inconsistency/Lack of conformity between the tour package and the program

Any violation in the execution of the contract must be promptly contested by the traveller to the organizer during the trip (by email or by phone), so that the organizer, their representative or the guide can correct it in a timely manner.  In the event that, based on the nature of the defect, it is possible to rectify it directly (for example, if the room is not suitable), but the traveller did not immediately inform the organizer of the defect, it is deemed that the traveller was in agreement with the service as provided and as a result loses their  right to successive claims, to request a reduction of the price of the tour package or to request refunds for any damages incurred because of this defect.

If the organizer does not remedy the lack of conformity, unless this latter proves to be impossible or excessively burdensome, the organizer is required to offer to the traveller, without additional costs, an alternative solution. The traveller may refuse this alternative solution only if not comparable to what was agreed in the travel contract. The acceptance of an alternative solution not comparable with what was agreed in the travel contract entails a refund from the organizer, equal to the difference in price between the original tour package and the replacement. In the event of withdrawal from the travel contract by the travellers for the motives cited above during the execution of the tour package, the organizer has the obligation to guarantee to the traveller transportation for his return to the place of departure that is equivalent to the original one.

MaroWays d.o.o. is not responsible for any flight, train or other transportation delays, and for any modifications to the tour package that result from such delays.

MaroWays d.o.o. is not responsible for modifications to the program of the tour package in the event of unpredictable and extraordinary circumstances that may arise during the performance of the tour package and upon which the organizer has no control. In this case, the organizer may supply to the traveller modified services according to the available possibilities. 

  1. Complaints

The traveller is entitled to a reduction in price and/or compensation for damages, for the non-performance of the tourist services or for any lack of conformity in their execution. 

The right to a reduction in price or compensation for damages lapses in two years starting from the date when the traveller returns to the place of departure. The complaint must be signed and given in writing. The traveller may make a complaint in favour of a third person only if he is in possession of a power of attorney that must be attached to the complaint, otherwise MaroWays d.o.o. will not take into consideration the complaint. The traveller is required to attach to the complaint all evidence in their possession that attests to their right to a reduction in price and/or compensation for damages.

MaroWays d.o.o is required to respond to the traveller in writing within 10 days, indicating in its response whether the justification for the complaint is well-founded or not. If 10 days are not sufficient to examine the case in question, MaroWays d.o.o. informs the traveller that the complaint is in dispute and then, without delay, retrieves all the information necessary to communicate the final decision to the traveller.

For any reduction in price or compensation for damages incurred by the traveller during the execution of a tour package, the refund cannot be higher than three times the price of the tour package.

MaroWays d.o.o. will not process claims for price reduction, damages and other claims unless received in writing. The complaint must be sent to MaroWays d.o.o., Kraška ulica, 2 SI – 6210 Sežana. MaroWays d.o.o. does not recognize any third person belonging to IRPS (Register izvensodnega reševanja potrošniških sporov) as competent for the resolution of complaints made by the traveller.

  1. Travel documents

Prior to booking, the traveller is provided with general information regarding passports, visas and health formalities necessary for entry into the country of destination. The information provided will be verified in the best possible way by the organizer, who is not responsible for the truthfulness of the information provided regarding travel documents, visas and compulsory vaccinations.

However, it is the responsibility of the traveller to ensure that the personal documents required for entry into the country are valid. He is also responsible for obtaining any visas and/or fulfilling any health formalities necessary for entry into the country of destination.  In the absence of these requirements, no responsibility and/or refund can be attributed to the organizer for the failure of one or more travellers to depart.

Unless otherwise specified in the tour package program, the traveller’s passport must have a residual validity of at least 6 months from the date of return from the trip. If the residual validity of the passport is less than 6 months from the date of return from the trip, the organizer recommends that the traveller starts the procedure for renewing his passport in an appropriate time.

  1. Loss of personal belongings/documents

In compliance with the legislation concerning transport (air, sea, rail, etc.) the traveller has the obligation to communicate all the necessary information of all the participants in the tour package. This information must correspond to the information on the travel documents that every traveller, in compliance with border crossing regulations and foreign regulations, is obliged to carry with him at all times. In the event that the communication of incorrect data by the traveller results in additional expenses, delays or suspension of the trip, it is the traveller himself who is responsible for the resulting costs for all participants of the trip.

In case of loss or theft during the tour package of personal documents necessary for the continuation of the trip or for the return of the traveller, the traveller recovers the new documents at his own expense. The traveller can ask the organizer for help and advice in dealing with the formalities.

In case the traveller is forced to interrupt the trip due to the loss or theft of personal documents, he is not entitled to any refund or compensation for damages.

During the tour package, the traveller is responsible for his personal belongings and documents. MaroWays d.o.o. is not responsible or liable for the theft, loss or damage of objects and personal documents owned by the traveller.

  1. Travel Insurance

No travel insurance is included in the participation fee. The organizer recommends that the traveller take out their own travel cancellation insurance with third parties, as well as medical insurance that includes medical and accident assistance.

  1. Beginning of the trip

The organizer is not liable for the expenses and damages due to the non-participation by the traveller in the tour package or in case of a delay in participation at the beginning of the trip. It is the responsibility of the traveller to ensure their punctual presence at the date, time and place set for the start of the tour package. He is also responsible for the transportation costs necessary to reach the place of departure. The organizer is also not liable for delays, cancellations or changes to the transport to or from the start or end of the trip.

  1. Warnings about possible risks

Some activities provided as part of tour packages may include physical activity that requires a certain physical condition on the part of the traveller. It is the responsibility of the traveller to check before making the booking whether their physical condition is adequate for the tour package. The traveller is not entitled to reimbursement of expenses or compensation for damages resulting from their physical condition during the execution of the tour package. 

  1. Traveller’s responsibility

The organizer is not liable for any damage caused by the traveller during the performance of the tour package in the places of accommodation or means of transport.

  1. Meals and special diets

Special diets (allergies and/or serious intolerances) must be reported to the organizer at the time of booking. Depending on the availability of the caterers, the organizer will try in every way to meet the traveller’s requests. For this kind of requests, the organizer has the right to ask for additional payment.

The traveller is not entitled to any refund or reduction of the price if for various reasons (e.g., change in the timetables of transport services, etc.) the meal included in the package price is not used.

  1. Travelling with minors

If not otherwise specified in the program of the tour package, the minimum age to participate in a tour package is 18. MaroWays d.o.o. may possibly agree with the traveller for the participation of persons who are under 18, who must in any case be over 12 years old and accompanied by at least one parent or guardian.

  1. Accommodation

The traveller who books individually, can choose between single room accommodation (at an additional price and depending on availability) or will be combined in a double room with another participant assigned by the organizer. Any requests for accommodation in single room or double room for single use must be communicated to the organizer at the time of registration for the tour package. The organizer will do its best to satisfy the traveller’s requests.

  1. Language in which services, documents and information are provided

The languages provided for the services, program and other information related to the tour package are English, Italian, and Slovenian.

  1. Luggage

If not otherwise specified in the tour package program, luggage transport is included in the price. In case luggage transport is not included in the price, the service can be requested at an additional price.

The organizer has no responsibility in case of damage, loss or theft of luggage and/or other valuables during transportation to the accommodation and during their stay in the premises of the accommodation.

  1. Customs, health and other regulations

The traveller is responsible for the compliance of his personal data and luggage data with the customs, health and other regulations in force in the Republic of Slovenia and other countries where they will travel. MaroWays d.o.o. informs the traveller of the regulations necessary for travel to the country of destination including customs and health regulations.

If the traveller is unable to continue the trip due to non-compliance with the regulations, they are   responsible for all expenses arising from their noncompliance. They are also not entitled to any refund of the price paid for the tour package nor to any compensation for expenses/damages.

The traveller must comply with the rules of conduct of the accommodation in which he stays or the facilities involved in the various services. In any case they must cooperate in good faith with the representative of MaroWays d.o.o.

In case the traveller does not respect the rules of conduct described in the upper paragraph, he alone is responsible for the damages caused. In this case MaroWays d.o.o. is not responsible for the damages caused and is free from any liability for any damage that may have occurred to the traveller.

  1. Protection in case of insolvency or bankruptcy 

In case of insolvency or bankruptcy by the organizer before the execution of the tour package, the price paid for the purchase of the tour package will be refunded.

In case of insolvency or bankruptcy during the execution of a tour package in which the transport of the traveller is included, the return will be assured. MaroWays d.o.o. guarantees protection in case of insolvency or bankruptcy at: Generali zavarovalnica d.d. – Kržičeva ulica 3, 1000 Ljubljana, Slovenija – info.si@generali.com – from Slovenia 080 70 77, from abroad: 00386 5 664 35 00. In case the execution of the services is not possible due to insolvency or bankruptcy problems, the consumer may contact this party or, if necessary, the competent authority.

  1. Use of personal data


The personal data acquired for the purpose of booking/execution of the tour package are processed by MaroWays d.o.o. for the purpose of the conclusion and execution of the contract with the traveller, all in compliance with the Data Protection Act and EU Regulation 2016/679 of the European Parliament and the Council (GDPR).

The traveller concluding the travel contract, is responsible for the personal data of other travellers communicated to MaroWays d.o.o. This personal data must be acquired by the traveller with the approval of the data subjects, and this latter must be made aware by the traveller of the content of the travel contract.

By adhering to the tour package, the traveller accepts that the personal data he has communicated will be processed for statistical purposes, for sending communications related to the tour package, for quality control and for sending communications related to future tour package offers by MaroWays d.o.o.

In case the traveller does not accept the processing of personal data for the purposes of the above paragraph, he can communicate it when registering for the tour package or even later. The traveller has the right to exercise all rights arising from the laws on the processing of personal data, such as the right of access, updating, rectification, cancellation, portability of personal data and the right to report to the competent authority.

  1. Additional Information

The information received by the traveller from MaroWays d.o.o., does not bind MaroWays d.o.o. further than the provisions defined in the program of the tour package, the terms and conditions and other written documents. In case of doubt, the provisions in the written documents always apply.

The photographs published on the website and advertising materials are of an informative nature. MaroWays d.o.o. does not guarantee the truthfulness of their data and their appearance.
